A.  General

1. Information on how to enter this Promotion, mechanics of entry and prizes form part of these Conditions of Entry. Entry into this Promotion is deemed acceptance of these Conditions of Entry by each Entrant.

2. Entry is open to Velocity Frequent Flyer members, who are at least 18 years of age and are an Australian resident (Entrants).   

3. The Promoter is Velocity Frequent Flyer Pty Ltd (ACN 601 408 824) of registered address 275 Grey Street, South Brisbane QLD 4101.

4. The directors, officers, management and employees (and their immediate families) of the Promoter and its related bodies corporate and agencies and third parties (including Flybuys, 7-Eleven, Virgin Wines and Velocity e-Store) associated with this Promotion are not eligible to enter this Promotion.

5. The Promotion commences at 12:01 am AEDT on 8 February 2024 and ends at 11:59pm AEDT on 29 February 2024 (Promotion Period).

B. Entry

6. Entrants will automatically receive one (1) entry into the Promotion each time they earn Velocity Points using the Entry Mechanisms set out below with any one (1) of the Participating Partners during the Promotion Period. Participating Partners include Virgin Australia, Flybuys, 7-Eleven, Velocity e-Store, and Virgin Wines.

Flybuys Entry Mechanism

Flybuys means Loyalty Pacific Pty Ltd (ABN 82 057 931 334), trading as “Flybuys”, PO Box 12125, A'Beckett Street, Melbourne, VIC 8006.

To qualify for this Entry Mechanism, Entrants must also be a member of the Flybuys program.

Eligible Velocity Points earn for the Promotion:

  • Manual Transfer: Entrants will receive one (1) entry for every one thousand (1,000) Flybuys points they manually transfer from their Flybuys account to their Velocity account during the Promotion Period; OR
  •  Auto Transfer: Entrants must opt-in to Auto Transfer (includes members who already have Auto Transfer turned on) and Entrants will receive one (1) entry for every one thousand (1,000) Flybuys points automatically transferred from their Flybuys account to their Velocity account during the Promotion Period.

If either transfer method is used, members will receive the standard transfer rate of five hundred (500) Velocity Points per one thousand (1,000) Flybuys points transferred.

Flybuys Transfer Terms and Conditions

There’s no limit to the amount of Flybuys points an Entrant can transfer into their Velocity account. Only one (1) Velocity membership can be linked to a Flybuys household at any one (1) time.

To turn on Auto Transfer, the full name and date of birth on the Entrant’s Flybuys household account and their linked Velocity membership must match. Entrants can de-link or manage their linked accounts at any time at partners.flybuys.com.au/velocity-frequent-flyer/. Entrants can visit experience.flybuys.com.au/rewards/travel/velocity-transfer to manually transfer their Flybuys points. Alternatively, to turn on Auto Transfer, Entrants can visit partners.flybuys.com.au/velocity-frequent-flyer/ and sign in to their Flybuys account then turn their Auto Transfer preference to ‘On’. This selection will apply to all members under that specific Flybuys household account. Entrants can turn their Auto Transfer preference to ‘Off’ at any time and will still be able to manually transfer their Flybuys points to Velocity.

Entrants must allow up to 48 hours for Velocity Points to be credited to their linked Velocity account and for their Flybuys points balance to be updated. Once Flybuys points have been redeemed for Velocity Points they can’t be returned to the Entrant’s Flybuys account. Standard Flybuys Terms and Conditions apply to the collection of Flybuys points. 7-Eleven Entry Mechanism

Eligible Velocity Points earn for the Promotion: Entrants must scan their valid Velocity membership card (either their physical card or using their Velocity app) or their Velocity-linked My Card (found in their My 7-Eleven app) before making payment for an Eligible Purchase (defined below), to earn Velocity Points for the purpose of entering this Promotion at 7-Eleven stores. 

Eligible Purchases are purchases at 7-Eleven stores across New South Wales, Victoria, Queensland, Western Australia and the Australian Capital Territory made using an Eligible Payment Method (defined below), other than purchases of Excluded Products (see below).

Excluded Products include tobacco, prepaid transport tickets, mobile phone products, gift cards and vouchers, parcel and hire services, purchases made online or via any home delivery services platform, and other excluded purchases designated on the 7-Eleven website. An Eligible Payment Method is any payment method other than: 7-Eleven Fuel Pass, any fleet card, Motorpass, vouchers, free offers or any other excluded payment method specified on the 7-Eleven website as ineligible for Velocity Points (each an “Ineligible Payment Method”). If an Entrant uses an Ineligible Payment Method to pay for their transaction, or their payment is declined and they do not complete the payment, the Entrant will not receive Velocity Points. 

Velocity Points are allocated to member’s accounts within 24 hours of completing a transaction, unless otherwise stated in connection with a specific promotional campaign.

Velocity membership is subject to the Velocity membership Terms and Conditions. Use of the My 7-Eleven app is governed by the My 7-Eleven app Terms and Conditions.

Virgin Australia Entry Mechanism

Eligible Velocity Points earn for the Promotion: Entrants can earn Velocity Points for the purpose of entering this Promotion when they fly on eligible domestic, Trans-Tasman and international short haul flights with Virgin Australia (where a flight is operated by Virgin Australia with a VA flight number) and add their Velocity membership number to the booking prior to travel. A Velocity membership number must be added to the booking to earn Points, and the name on the booking must match the name on the Velocity membership. Points are earned at the time of flying, not at the time of booking.

Virgin Australia operated flights with a partner airline flight number (e.g. your flight number does not start with “VA”), a flight with a VA number (as part of an international journey with a partner airline), Reward Seat bookings and bookings on charter services will not be eligible for the purpose of entering this Promotion.

Velocity e-Store Entry Mechanism

Eligible Velocity Points earn for the Promotion: Entrants will earn Velocity Points for the purpose of entering this Promotion when they log into the Velocity e-Store using their Velocity membership details, and purchase eligible products from retailers via links from the Velocity e-Store website or the Velocity App, or purchase from retailers and have logged their purchase through the Shop and Earn extension for the Velocity e-Store.

Only selected items purchased through the Velocity e-Store are eligible to earn Points. To earn Velocity Points, the Entrant must be logged into the Velocity Store website (using their Velocity membership number and password) and access the retailer's website via the links from the Velocity e-Store. In using the Velocity e-Store, the Entrant agrees to the use of cookies to track and record purchases made by the Entrant via the Velocity e-Store. It is the Entrant's responsibility to ensure that cookies are turned on in their browser and that the security settings in their browser allow the use of cookies. Virgin Wines Entry Mechanism

Eligible Velocity Points earn for the Promotion: Entrants will earn Velocity Points for the purpose of entering this Promotion on eligible purchases  from Virgin Wines.  Velocity Points are earned on the cost of wine only (excluding shipping). Entrants must provide their Velocity Membership Number at the time of purchase to earn Points. Points will be credited to your account within 30 days.

Virgin Wines does not deliver to parcel lockers or to the Northern Territory. Virgin Wines standard terms and conditions of sale apply and be found at virginwines.com.au/terms 

Virgin Wines Privacy Policy: Virgin Wines collects the Entrants personal information in accordance with their Privacy Policy, so that they can process Entrants orders, and provide information and offers. Without the Entrant’s information, Virgin Wines may not be able to provide the Entrant with services or information and Entrants may miss out on receiving valuable information about Virgin Wines. Virgin Wines disclose the Entrants personal information to Virgin Wines group members and third party service providers who may be located overseas including in UK and USA, and Entrants consent to this disclosure. Entrants have a right to access their personal information that Virgin Wines hold and may request Virgin Wines to correct this. Velocity membership and Points earn and redemption are subject to the Velocity membership  Terms and Conditions, as amended from time to time

7. Multiple entries permitted, subject to the following: (a) a maximum of fifty (50) entries per person across all Entry Mechanisms; and (b) each entry must be submitted separately and in accordance with entry requirements.

8. Winners are only eligible to win one (1) Prize as part of this Promotion (excluding SA residents).

9. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission.  Entries received will be considered final by the Promoter. Illegible, incomprehensible and incomplete entries will be deemed invalid. The Promoter and third parties associated with the Promotion accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise including those entries not received by the Promoter.

10. The Promoter encourages consumers to enjoy responsibly.  Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.

11. If Entrants enter into the Promotion but no longer wish to participate, they can email info@velocityfrequentflyer.com or call 13 18 75 and they will be removed from the Promotion.

12. Any costs associated with entering the Promotion is the Entrant’s responsibility and may vary.

13. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

14. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an Entrant provides will only be used for the purposes outlined in these Conditions. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook or Instagram. Facebook or Instagram will not be liable for any loss or damage or personal injury, which is suffered or sustained by an Entrant, as a result of participating in the Promotion (including taking/use of a Prize), except for any liability which cannot be excluded by law. The Entrant releases Facebook and Instagram and their associated companies from all liabilities arising in respect of the Promotion. Any questions or comments regarding the Promotion must be directed to the Promoter, not to Facebook or Instagram.

C. Drawing Winners

15. The draw will be conducted on 18 March 2024 at 11:00 am AEDT at Anisimoff Legal, G13, 3 Amy Close, North Wyong NSW 2259. All decisions of the Promoter are final and no discussions or correspondence will be entered into by the Promoter. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner or winners (a Winner) will be notified in writing within two (2) business days of the draw and their name will be published at velocityfrequentflyer.com/member-support/media-centre by 20 March 2024.

16.  If a prize is not claimed within three (3) months of the draw, a redraw will occur. A draw for any unclaimed prize may take place on 18 June 2024 at the same time and place as the original draw, subject to any directions from a regulatory authority.

17. A redrawn Winner, if any, will be notified in writing within two (2) business days of the re-draw. The name of any re-draw Winner will be published at velocityfrequentflyer.com/member-support/media-centre by 20 June 2024

18. Entries not fully complying with these Conditions of Entry may be deemed invalid at the Promoter’s discretion. If a winning entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and the relevant prize will be re-awarded in accordance with the relevant clause of these Conditions as if the discarded entry had not been received.

19. This is a game of chance and skill plays no part in determining the outcome.

D. Prize

20. There are forty-seven (47) prizes to be won, as set out below.

First Prize (x10)

The first ten (10) valid entries drawn will each win:  One hundred thousand (100,000) Velocity Points. Each Velocity Points Prize is valued at AUD$3051.60.  Total prize value AUD$30,516

Velocity Points will be allocated by 29 March 2024.  Use of Velocity Points is subject to the Velocity Membership Terms and Conditions, which are located on the Velocity Frequent Flyer website at: https://www.velocityfrequentflyer.com/member-support/terms-conditions

Each Velocity Points Prize may be redeemed for goods and services with a value of AUD$3051.60. Velocity Points will be allocated to the Winner’s Velocity membership account only. Value is based on a sample of the Velocity Points options that could be obtained by redeeming the Prize through the Velocity program at the time of this Promotion. The value of the Velocity Points may vary depending on how and when they are redeemed by the Winner through the Velocity Points program.

Second Prize (x10)

The next ten (10) valid entries drawn will each win: A certificate for a return Economy Class flight (including relevant flight connections) with Virgin Australia on Virgin Australia’s domestic network for two (2) people from the Winner's closest home port serviced by Virgin Australia (“Prize Certificate”). Each Prize Certificate is valued at up to $1,000. Total Prize Certificate prize in this Promotion is valued at up to $10,000.

The Prize Certificate is subject to the following terms and conditions:

1. Prize Certificates expire 12 months from the date of issue. The Expiry Date cannot be extended. The Winner’s outbound flight must depart prior to the Expiry Date of this Prize Certificate.

2. Both the Prize Certificate and flights are non-redeemable for cash.

3. Tickets redeemed under this Prize Certificate are valid on Virgin Australia operated flights only and not codeshare services.

4. Tickets are non-transferrable (ie. no name changes allowed after ticketing).

5. The Winners and their companions must depart from and return to the same departure point and travel together.

6. All bookings are subject to the fare rules applicable to the fare. The Prize Certificate can only be used to book tickets in the following Fare Class – X class. Bookings are subject to availability of fares for prizes in this fare class.

7. All bookings are subject to availability. Blackout periods apply:

  • 29 March 2024 to 26 April 2024;
  • 22 June 2024 to 19 July 2024;
  • 14 September 2024 to 11 October 2024; and
  • 16 December 2024 to 06 January 2025.

8. All bookings need to be made at least seven (7) days prior to travel.

9. Bookings can be requested via email at prize.winners@virginaustralia.com. Open Monday - Friday between 09.00 - 17.00 AEST.

10. Bookings that have been paid for using the Prize Certificate cannot be changed or cancelled online. A Winner will need to contact the Guest Contact Centre. Changes or cancellations may be subject to a fee in accordance with fare rules applicable to the Winner’s booking. Changes and cancellations are subject to availability and must be made before the travel date. Fare differences may apply.

12. Passengers who do not notify Virgin Australia at least 24 hours prior to scheduled departure that they are unable to take the booked flight will forfeit the Prize Certificate.

13. Prize Certificates or Tickets may not be sold or offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original recipient or any subsequent bearer. If a Prize Certificate or Ticket is sold or used in breach of this condition, it will be cancelled at Virgin Australia’s sole discretion.

14. Tickets cannot be upgraded and are not valid to earn Velocity points or status credits.

15. The Winners and their companions are responsible for ensuring that they have the requisite visas, vaccinations, valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be their sole responsibility.

18. A Winner is responsible for all other expenses including accommodation, spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, service charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

Third Prize (x10)

The next ten (10) valid entries drawn will each win:  $500 Coles Digital Gift Card.  Each prize is valued at $500. Total prize value is $5,000.

The Coles Digital Gift Card will be sent to the Winner’s nominated email address associated with their Velocity account within 28 days. After the Winner is drawn and the Winner has accepted the prize, Gift Cards will be sent to the Winner’s nominated postal address within 28 days.

21.  Total prize value is AUD$49,866 (including GST). The Prizes are awarded “as is” with no warranty or guarantee, either express or implied by the Promoter, subject to law. Prizes are not substitutable, exchangeable, transferrable and cannot be taken as cash, unless otherwise stated.

22. If any Prize (or part of a Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

23. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination or as part of the Prize.

24. Subject to the unclaimed Prize draw clause, if for any reason a Winner does not take/redeem a Prize (or an element of a Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.

E. Contacting the Entrant

25. By entering this Promotion, Entrants agree to be contacted in relation to this Promotion by the Promoter. Should an Entrant’s contact details change during the Promotion Period, it is the Entrant’s responsibility to notify the Promoter.

26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

27. The Promoter reserves the right to request that an Entrant or Winner provides proof of identity, proof of age, proof of residency and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the prize in whole and no substitute will be offered.

28. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Participating Store of purchase and that the purchase was made during the Promotional Period but prior to entry.

29.  If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.

F. Intellectual Property

30.  Each Entrant releases and indemnifies the Promoter and agencies associated with the Promotion against all liability, cost, loss or expense arising out of acceptance of any Prize or participation in the Promotion including (but not limited to) personal injury and damage to property, except to the extent that such liability, cost, loss or expense is caused or contributed by the Promoter’s or its associated agency’s negligent or wrongful act, subject at all times to law.  

G. Tax

31. The Promoter will not be liable for any tax liability, including without limitation income tax, fringe benefits tax, or any liability or loss of opportunity due to reportable fringe benefits, incurred by a Winner, an Entrant, their family, associates, employer and/or any other party due to participation in the Promotion, the acceptance or use of any prize, or the acceptance, receipt or redemption of Velocity Points.

32. Entrants, the Winner and/or other such relevant party will be required to pay any taxes and other airport related charges (including any applicable GST on those taxes and charges) which may be due on receipt or use of the prize or the receipt or redemption of Velocity Points.

33. Entrants should seek independent financial advice to ensure they understand possible tax implications in relation to any tax liability and/or reportable fringe benefits before acceptance or use of a prize or the receipt or redemption of Velocity Points.

34. The Promoter, its agents and associated entities do not accept responsibility for and makes no representations about any tax liability as a result of participating in the Promotion or from receiving or using any of the prizes or from receiving or redeeming Velocity Points.

35.  Flybuys, 7-Eleven, Virgin Wines, Velocity e-Store (operated by Collinson) and Virgin Australia will ensure that all promotional and marketing material prepared by them relating to the Promotion sufficiently notifies Entrants of these Conditions.

H. Legal

36.  The Promoter reserves the right to verify the validity of entries and to:

(a) disqualify any entry which in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, or does not comply with these Conditions;

(b) disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions  or who engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of this Promotion; or

(c) disqualify any entrant (and any of their entries) who has, in the opinion of the Promoter, engaged in conduct when entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.

The Promoter reserves the right to disqualify a Winner if the Promoter becomes aware that the Winner and/or the Winner’s entry is of a type described in this clause. Any entrant disqualified under this clause is prohibited from any further participation in the Promotion.  Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

37. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion, or provide the Prizes, on the dates and in the manner described in these Conditions of Entry, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under relevant legislation.

38. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to any written direction given under relevant legislation.

39. To the extent permitted by law, the Promoter and its associated entities (and their respective officers, employees and agents) are not responsible for and exclude all liability for any direct, indirect or consequential injury, loss and/or damage arising in any way in connection with this Promotion or any prize/s. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect or inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; (iv) any variation in prize value to that stated in these Conditions; and (v) acceptance and/or use of any prize (including but not limited to any component of a Winner’s trip).  

40. Flybuys is not liable for any loss, expense, damage or liability that may be suffered or incurred by a person in entering this Promotion via the Flybuys Entry Mechanism. Nothing in this paragraph A restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).   

41. The Promoter collects personal information for the purpose of conducting the Promotion, including providing any prize to the Entrant. If the Promoter cannot collect an Entrants personal information, the Promoter will not be able to enter an Entrant in the Promotion or provide them with a prize. The Promoter may also disclose an Entrant’s personal information to and/or collect the Entrant’s personal information from its related companies (including Virgin Australia Airlines Pty Ltd and Velocity Rewards Pty Ltd) and third parties who provide (or help the Promoter provide) products and services. The Promoter may disclose an Entrant’s personal information to persons or organisations located in overseas countries, as described in the Promoter’s Privacy Policy (https://experience.velocityfrequentflyer.com/member-support/privacy/privacy-policy).   The Promoter’s Privacy Policy also states how an Entrant can seek to access or correct their personal information and how to make a privacy complaint.  Entrants can contact the Velocity Frequent Flyer Privacy Officer in at privacy@virginaustralia.com.

42. Entrants consent to the Promoter using their personal information for future promotional and marketing purposes regarding the Promoter’s products and services, including contacting the Entrant via SMS and email messages (and Entrants consent to receive such messages from the Promoter).  Information on how to opt-out from these messages is set out in the Promoter’s Privacy Policy.  Flybuys uses and manages its members personal information in accordance with its privacy policy https://experience.flybuys.com.au/policies/privacy-policy/. 

43. Entrant’s personal information may be disclosed to State and Territory lottery departments and Winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
