These Terms and Conditions contain important terms that you should be aware of, specifically:
1. INTRODUCTION
1.1 General
(a) Membership to Virgin Australia Beyond (operated by Virgin Australia) is subject to these Terms and Conditions, and any applicable law. Use of the Virgin Australia Beyond benefits will be taken as acceptance of these Terms and Conditions. Members and Virgin Australia are responsible for complying with these Terms and Conditions.
(b) These Terms and Conditions are in addition to the Velocity Frequent Flyer Terms and Conditions. In the event of an inconsistency between these Terms and Conditions and the Velocity Frequent Flyer Terms and Conditions, these Terms and Conditions will apply to the extent of the inconsistency.
(c) Members have certain rights under the Australian Consumer Law. These include Consumer Guarantees that the services we provide to Members will be carried out by us with due care and skill, will be fit for the purpose we disclose, and will be supplied within a reasonable time. Where we fail to provide services to Members in accordance with these Consumer Guarantees or otherwise in accordance with these Terms and Conditions, then Members may have a right to seek a remedy from us in accordance with the Terms and Conditions, our policies, and any applicable law, including the Australian Consumer Law. Nothing in these Terms and Conditions exclude or limit the Consumer Guarantees or any other statutory rights that Members may have under applicable laws (including the Australian Consumer Law) that cannot be excluded. Members can find out more about the Consumer Guarantees here. This is a summary of some of Your rights under the Australian Consumer Law. It is not an exhaustive list and is not legal advice.
1.2. Changes to these Terms and Conditions
(a) Virgin Australia may vary these Terms and Conditions from time to time. We will act reasonably in making changes and publish any changes to the Terms and Conditions within the Member’s Velocity account.
(b) If we make a change to the Program or these Terms and Conditions, we will try to provide the following reasonable notice through the email recorded in the Member’s Velocity account:
(i) 30 days’ notice if a significant change is required
(ii) 14 days’ notice if other changes are required.
(c) We may provide Members with less or no notice if urgent changes are required, such as to comply with applicable Laws, or where we cannot control the timing of a change (for example, due to arrangements with third parties).
2. DEFINITIONS
Unless the context otherwise requires, the following definitions apply:
Airline Partners means an airline partner of Velocity Frequent Flyer, not including Virgin Australia.
Associated Lounges means lounges operated by another airline or third party with which Virgin Australia has an agreement for use of the lounge by certain guests.
Benefit Period means the following period:
(i) 12 months from the date that you are upgraded or maintain your Membership; or
(ii) A short-term period determined by Virgin Australia in its absolute discretion for Pilot Memberships.
Chief Executive Officer means the Chief Executive Officer of Virgin Australia.
Invited Guests means a person who enters a Virgin Australia Beyond Lounge as a guest of a Member.
Loss means any loss, damage, cost or expense, including consequential or indirect loss, loss of savings, business opportunities, revenue, profit and/or damage to goodwill.
Lounge means the lounges operated by Virgin Australia for Virgin Australia Lounge membership holders, Velocity Frequent Flyer members (where applicable) and their guests.
Lounge Guest means any individual who is eligible to access a Virgin Australia Lounge.
Member means a Virgin Australia Beyond Member or Partner Member.
Membership means membership of Virgin Australia Beyond and includes Pilot Membership.
Membership Card means the digital card that is issued by Virgin Australia when you become a Virgin Australia Beyond Member and replaces your Velocity Frequent Flyer membership card.
Occupant means a Lounge Guest who has entered and is occupying a Virgin Australia Beyond Lounge.
Partner Member means a person who has been nominated for Partner Membership by a Virgin Australia Beyond Member.
Partner Membership means the membership to Virgin Australia Beyond which is granted to a Virgin Australia Beyond Member’s spouse or life partner, as nominated by the Virgin Australia Beyond Member.
Pilot Membership means the ability to trial membership of Virgin Australia Beyond for a period determined by Virgin Australia, following an invitation by Virgin Australia.
Review Date means a date within the Benefit Period that Virgin Australia reviews a Virgin Australia Beyond Member’s Membership and determines, in its sole discretion. whether to renew that Virgin Australia Beyond Member’s Membership for a subsequent Benefit Period.
Terms and Conditions means the terms and conditions which apply to Membership, as set out in this document and as amended from time to time by Virgin Australia.
Velocity Frequent Flyer means the loyalty program (as amended from time to time) of Virgin Australia which is owned and operated by Velocity Rewards Pty Ltd ACN 116 089 448.
Velocity Frequent Flyer Terms and Conditions mean the terms and conditions which apply to membership of Velocity Frequent Flyer, available here.
Virgin Australia, us or we, means Virgin Australia Airlines Pty Limited ABN 36 090 670 965.
Virgin Australia Beyond means the program outlined in this document.
Virgin Australia Beyond Lounge means the lounges operated by Virgin Australia exclusively for members of Virgin Australia Beyond.
Virgin Australia Beyond Member means a guest invited to be a member of Virgin Australia Beyond.
Virgin Australia Beyond team means the exclusive team which are available 7 days per week during specified hours and is available for members of Virgin Australia Beyond.
Virgin Australia domestic means flights operated within Australia by Virgin Australia.
Virgin Australia international short haul means flights operated between Australia and New Zealand, the Pacific Islands and Southeast Asia.
3. MEMBERSHIP
3.1 Virgin Australia Beyond Membership
(a) Membership to Virgin Australia Beyond is by invitation only.
(b) Members must be members of the Velocity Frequent Flyer program.
(c) Members will receive the benefits set out in these Terms and Conditions, and any other benefits, which we may advise the Member of from time to time.
(d) Any benefits provided to Virgin Australia Beyond Members are in addition to the Velocity Platinum benefits, which a Virgin Australia Beyond Member is entitled to access. A Virgin Australia Beyond Member’s benefits and entitlements under the Velocity program are governed by the Velocity Frequent Flyer Terms and Conditions, and may change from time to time.
(e) Membership will be reviewed prior to the expiry of each Benefit Period.
(f) Memberships are not transferable (other than in accordance with these Terms and Conditions).
3.2 Partner Membership
(a) A Virgin Australia Beyond Member may nominate one spouse or life partner for Partner Membership by contacting the Virgin Australia Beyond team.
(b) The Partner Member will be entitled to receive all the benefits of Membership, subject to these Terms and Conditions.
(c) A Partner Member is not required to travel with the nominating Virgin Australia Beyond Member in order to receive the benefits of Partner Membership.
(d) In the event a Virgin Australia Beyond Member’s Membership is terminated, the Membership of their nominated Partner Member will also be terminated, unless otherwise determined by Virgin Australia.
(e) In the event a Virgin Australia Beyond Member elects to replace the recipient of the Partner Membership, the Member must provide written notice to the Virgin Australia Beyond team. The existing recipient’s Partner Membership will cease (from the date we are notified of the change), and benefits associated with the Partner Membership will be transferred to the new nominee, unless otherwise determined by Virgin Australia.
(f) Partner Membership expiry dates are linked to the Virgin Australia Beyond Member’s expiry date regardless of whether there has been a change in nominee of the Partner Member.
3.3 Membership Card
(a) Members will receive a Membership Card which can be accessed via the Virgin Australia or Velocity Apps on a smart device.
(b) Copies or screenshots of Membership Cards will not be accepted as proof of Membership.
(c) Membership Cards will show the Member’s name, Velocity number and Review Date. Membership Cards are valid for use only by the nominated Member, up until the Review Date shown, and are not transferable.
(d) We, and our Airline Partners, reserve the right at any time to require Members to produce their Membership Card while travelling, in order to utilise any benefit outlined in these Terms and Conditions.
3.4 Termination of Membership by Member
(a) A Member may choose to terminate their Membership at any time by giving written notice to Virgin Australia.
(b) A Virgin Australia Beyond Member may choose to terminate a Partner Member’s Membership at any time by giving written notice to Virgin Australia.
(c) If a Member wishes to terminate their membership of Velocity Frequent Flyer, the Member must terminate that membership in accordance with the Velocity Frequent Flyer Terms and Conditions. For clarity, a Member’s termination of their Velocity membership will result in immediate termination of their Virgin Australia Beyond membership.
3.5 Termination of Membership by Virgin Australia
(a) If Virgin Australia is reasonably of the opinion that a Member has failed to meet their obligations under clause 4, we will provide the Member with a notice of termination or suspension, as is reasonably practicable in the circumstances.
(b) If we reasonably suspect that the Member has breached these Terms and Conditions or the Velocity membership terms and conditions, we may:
(i) End the Membership or suspend the Membership while we investigate the issue
(ii) Cancel or refuse to honour any Membership benefits that the Member has redeemed or been provided with
(iii) Make any other decision or take any other action that we think is reasonably necessary in the circumstances.
(c) Other than as set out below, if we are considering ending the Membership because of a breach of these Terms and Conditions or the Velocity Frequent Flyer Terms and Conditions, we:
(i) Will provide the Member with written notice of the breach and 14 days to remedy the breach (if it can be remedied); and/or
(ii) May ask for an explanation why we should not end the Membership and will take this into consideration when making our decision about whether to terminate the Membership.
(d) Circumstances in which we may consider it reasonable to immediately suspend a Membership without notice include if we:
(i) Identify or suspect potentially fraudulent or dishonest activity in connection with the Membership
(ii) Suspect the Member dealt with, or attempted to deal with, Member benefits other than in accordance with these Terms and Conditions (e.g., an attempt to sell, transfer or otherwise deal with your or someone else’s Membership).
(e) If Membership has been granted to you due to you holding a specific corporate or government position, we may terminate your Membership, by providing 30 days’ written notice, upon being made aware that you no longer hold that position.
(f) Membership will automatically terminate on the death of a Member. Membership cannot be transferred to executors, administrators, or beneficiaries of an estate.
(g) In the event a Virgin Australia Beyond Member’s Membership is terminated, the Membership of their nominated Partner Member will also be terminated, unless otherwise determined by Virgin Australia.
(h) For clarity, Velocity Frequent Flyer may separately suspend or end the Member’s Velocity Frequent Flyer membership in accordance with the Velocity Frequent Flyer Terms and Conditions.
3.6 Effect of termination on the Membership
(a) On termination of the Membership for any reason, all benefits associated with Virgin Australia Beyond will cease.
(b) To the extent permitted by law, neither Virgin Australia nor Velocity Frequent Flyer will be liable for any Loss whatsoever which the Member or anyone else may suffer as a result of any termination of the Membership.
(c) Upon termination or expiry of your Membership, Virgin Australia will:
(i) determine your eligibility to remain within the Velocity program; and
(ii) make a determination regarding the appropriate Velocity tier for your continued Velocity membership.
4. YOUR OBLIGATIONS
(a) Members must act fairly and reasonably in all matters connected with their Membership. This obligation includes that Members:
(i) Must not give us any incorrect or incomplete information in connection with their Membership
(ii) Will not in any way attempt to sell, barter, transfer or otherwise deal with any benefits (including Points, Status Credits and Rewards) connected with the Membership and not otherwise abuse or misuse any benefits afforded as a Member
(iii) Not engage in conduct which is unlawful or illegal, or which brings Virgin Australia Beyond, the Virgin Australia Beyond team, Velocity Frequent Flyer, Virgin Australia or an airline partner of Virgin Australia or Velocity Frequent Flyer into disrepute, or engage in conduct which is in breach of these Terms and Conditions and any other terms and conditions associated with their Membership
(iv) Must tell us if any details we have recorded concerning the Member, or Partner Member changes, as soon as practicable after the change. This can be done by calling the Virgin Australia Beyond team. Before recording any change, the Member agrees to provide us with written proof, if reasonably requested by us, for verification purposes
(v) Agree that producing your Membership Card or quoting your Membership Number may be required as a precondition of any activity which may result in your claim to Points, Status Credits, rewards or other benefits
(vi) Must ensure their authorised representative/s deal with their Membership and Membership Account in accordance with these Terms and Conditions
(vii) Be respectful to all Virgin Australia and Velocity Frequent Flyer team members, other Members and other Lounge Guests.
5. MEMBERSHIP BENEFITS
5.1 Virgin Australia Beyond Team
(a) Members are entitled to contact the Virgin Australia Beyond team, an exclusive team which are available 7 days a week between 6am and 7pm Monday to Friday, and 7am and 6pm Saturday and Sunday, for assistance with any membership queries and bookings. The Virgin Australia Beyond team can be contacted by phone on 1800 041 404 or via email at beyond@virginaustralia.com.
5.2 Virgin Australia Beyond Lounge
(a) In selected ports, Members are entitled to access the exclusive Virgin Australia Beyond Lounges when travelling on a Virgin Australia domestic flight that same day. Access and use of the Virgin Australia Beyond Lounge is subject to the terms and conditions outlined in clause 6.
5.3 Baggage Allowance
(a) Members and Partner Members may each check-in up to 5 pieces of checked baggage when flying on Virgin Australia operated flights, on all eligible fare types, excluding Economy Lite fares (which does not include a baggage allowance). No single item may exceed 32kg.
(b) Members and Partner Members may each carry one personal item such as laptop or handbag, plus:
(i) One standard carry-on baggage piece, not exceeding 7kg or;
(ii) Two small pieces, not exceeding 7kg each or;
(iii) One standard piece plus one suit pack, not exceeding 7kg each.
(c) Members acknowledge that carry-on baggage limits exist due to the limited space in the aircraft cabin, as well as the importance we place on the safety and comfort of our guest and crew.
(d) Excess baggage fees will not be waived for Members with an onward connection onto one of our Airline Partners.
(e) When travelling on a flight operated by an Airline Partner, Velocity Platinum benefits of additional baggage allowance will apply if applicable to the Airline Partner.
(f) Carriage of baggage on an Airline Partner will be subject to the Airline Partner’s own terms and conditions. Check the relevant Airline Partner’s website for more information.
5.4 Executive Assistants
(a) Each Benefit Period, a Virgin Australia Beyond Member may nominate one executive or personal assistant who will be provided with Velocity Frequent Flyer Gold membership. Virgin Australia Beyond Members can make this nomination by contacting the Virgin Australia Beyond team.
(b) The executive or personal assistant will need to meet the standard criteria listed in the Velocity Frequent Flyer Terms and Conditions in order to maintain Gold Status.
(c) In the event a Virgin Australia Beyond Member wishes to remove, or amend the details of, their nominated executive or personal assistant, written notice must be provided to Virgin Australia Beyond team.
(e) The provision of Velocity Frequent Flyer Gold membership to executive and personal assistants is subject to the Velocity Frequent Flyer Terms and Conditions.
5.5 Upgrade Using Points
(a) All Members are entitled to redeem Points for seat upgrades to Business Class on Virgin Australia domestic and Virgin Australia international short haul flights, when a Flex or Choice Fare is purchased (Upgrade Using Points).
(b) An Upgrade Using Points can be redeemed by the Member for their own use, or for the use of another Velocity member.
(c) Points used to redeem an Upgrade Using Points will be deducted from the Member’s Velocity Frequent Flyer Membership Account at the time of the upgrade.
(d) An Upgrade Using Points is subject to the availability of seats assigned for upgrades on Virgin Australia domestic and Virgin Australia international short haul flights.
(e) Upgrades Using Points can be redeemed by calling Virgin Australia Beyond at least 30 minutes before the scheduled departure time for domestic flights, and 60 minutes before the scheduled departure time for international short haul, while the flight is still open for check-in.
(f) Full catering may not be assured for upgrades requested within 3 hours prior to the scheduled time of departure.
(g) If the Member makes any changes or cancellations to their flight after redeeming an Upgrade Using Points, any difference in Points owing to the Member will be refunded to their Velocity Frequent Flyer Membership Account.
(h) Members will earn Status Credits and Points based on the original fare class booked for flights where an Upgrade Using Points has been redeemed.
(i) Upgrades Using Points are not available on domestic flights booked as part of an international itinerary.
(j) Upgrades Using Points are not available on Economy Lite fares.
5.6 Fly Ahead or Fly Later
(a) Members with a confirmed booking for a Virgin Australia marketed and operated domestic flight, and who arrive at the airport in time for an earlier flight, can request they, and up to 3 accompanying guests on the same booking, be carried on an earlier flight (Fly Ahead).
(b) Members with a confirmed booking for a Virgin Australia marketed and operated domestic flight who request to be carried on a later flight on the same day, can request that they, and up to 3 accompanying guests on the same booking, be carried on a later flight (Fly Later).
(c) Fly Ahead or Fly Later requests are not available to Members travelling on Economy Lite fares or group bookings.
(d) For the avoidance of doubt:
(i) Fly Ahead is only available for an earlier Virgin Australia domestic flight on the same date of the ticketed Virgin Australia marketed and operated flight
(ii) Fly Later is only available for a later Virgin Australia domestic flight on the same date of the ticketed domestic Virgin Australia marketed and operated flight.
(e) Fly Ahead and Fly Later flights are subject to availability which is controlled by Virgin Australia.
(f) Requests can be made by contacting Virgin Australia Beyond, or in person at either a Virgin Australia Beyond Lounge or a Virgin Australia Lounge. Fulfilment of your request is not guaranteed and is subject to the following conditions:
(i) The Member and accompanying guests (if applicable) must hold confirmed seats on the same Virgin Australia marketed and operated domestic flight and be travelling to the same place in the same booking as the Member
(ii) Requests must be made at least 30 minutes before the scheduled departure of the booked flight, while the flight is still open for check-in
(iii) Members and accompanying guests (if applicable) must not have any check-in baggage. Hand luggage, in the quantity outlined in clause 5.3, is permitted.
(g) Seats must be available in the same cabin as the cabin originally purchased by the Member, on the eligible Fly Ahead or Fly Later flight. Catering is not guaranteed on the Fly Ahead or Fly Later flight.
(h) Routing changes to the Fly Ahead or Fly Later flight are not permitted and must remain as a single Flight Sector.
(i) No guests on the earlier Virgin Australia domestic flight will be displaced to accommodate a request.
(j) If the request is granted and the Member and accompanying guests (if applicable) are moved to an earlier or later Virgin Australia flight in a lower fare class than what was originally purchased, no refund of any fare difference will be provided (unless you are entitled to a refund under the Australian Consumer Law).
5.7 Guaranteed Economy Reward Seats for an Annual Family Trip
(a) Members will be guaranteed reward seat availability for one booking per Benefit Period for up to four guests on either:
(i) Virgin Australia domestic Economy Reward Class return flights, excluding flights to Cocos Island and Christmas Island; or
(ii) Economy Reward Class return flights departing from Australia (or from New Zealand for New Zealand based Members) to any international destination operated by Virgin Australia.
(b) The Member must be included and travelling in the booking for the Guaranteed Reward Seats for an Annual Family Trip.
(c) If the Member is unable to find the Economy Reward Class flights, the Member can call the Virgin Australia Beyond team to redeem the Guaranteed Reward Seats for an Annual Family Trip.
(d) The request for Guaranteed Reward Seats for an Annual Family Trip on domestic flights must:
(i) Include the desired departure and return dates, destination and number of guests travelling
(ii) Be made at least 3 months prior to the desired date of departure
(iii) Allow for a 3-day booking window for each flight (one day either side of the desired departure and return dates).
(e) The request for Guaranteed Reward Seats for an Annual Family Trip on international flights must:
(i) Include the desired departure and return dates, destination and number of guests travelling
(ii) Be made at least 3 months prior to the desired date of departure
(iii) Allow for a 7-day booking window for each flight (three days either side of the desired departure and return dates).
(f) If there is no direct flight available from the Member's desired airport of departure in Australia, we may offer to fly the Member and their travelling guests to a more suitable Australian airport for departure, at our expense.
5.8 Priority Economy Seat
(a) If there are no available seats for sale online in the Economy cabin on a Virgin Australia flight, Members may be able to purchase up to two Full Economy Flex fare seats on that flight (must be full Economy fare / ‘Y’ class), subject to these rules:
(i) The Member must be included in the Priority Economy Seat booking and must travel on the flight
(ii) The Priority Economy Seat booking must be made by calling the Virgin Australia Beyond team no later than 60 minutes prior to departure for domestic flights and no later than 90 minutes prior to departure for international flights. The booking cannot be made at any airport service desk or through the Virgin Australia or Velocity websites.
(b) This benefit may be restricted without prior notice e.g., for certain routes or under special circumstances (including natural disasters).
5.9 Complimentary Fare Upgrades
(a) Members are entitled to a complimentary upgrade to Business Class on Virgin Australia marketed and operated domestic or international short haul flights (excluding Christmas Island and Cocos Island). Allocation of entitlements are based on the following Benefit Periods:
(i) Four Complimentary Fare Upgrades when offered Beyond Membership
(ii) Two Complimentary Fare Upgrades when offered Pilot Membership
(b) Complimentary Fare Upgrades are redeemable from Choice or Flex fares to a Business Class fare. Economy Lite fares are not eligible.
(c) Complimentary Fare Upgrades can be redeemed:
(i) By calling the Virgin Australia Beyond team, either at the time of booking or no later than 2 hours prior to scheduled flight departure
(ii) At a Virgin Australia Beyond Lounge or a Virgin Australia Lounge no later than 30 minutes prior to the scheduled flight departure time. Catering is not guaranteed within 3 hours of flight close.
(d) Complimentary Fare Upgrades will expire if not redeemed. The travel dates for Complimentary Fare Upgrade flights are not required to be within the current Benefit Period.
(e) Members may choose to redeem a Complimentary Fare Upgrade for a guest who is travelling with them on the same flight.
(f) Complimentary Fare Upgrades are subject to the availability of seats assigned for upgrades by Virgin Australia. Some flights may have no upgrades available.
(g) Members will earn Status Credits and Points for Complimentary Fare Upgrade flights based on the original fare class booked.
6. VIRGIN AUSTRALIA BEYOND LOUNGE
6.1 General
(a) Access to and use of the Virgin Australia Beyond Lounge is governed by the provisions outlined in this clause and the Virgin Australia Lounge Terms and Conditions. In the event of any inconsistencies between the provisions in this clause and the Virgin Australia Lounge Terms and Conditions, the provisions of this clause will prevail to the extent of the inconsistency.
(b) Members are entitled to access a Virgin Australia Beyond Lounge, during operating hours, if they are travelling on a Virgin Australia domestic or international short haul flight, departing on the same day.
(c) Virgin Australia Beyond Lounges will open one hour prior to the first Virgin Australia departure of the day, and close at the scheduled time of the last Virgin Australia departure. Virgin Australia Beyond Lounge operating hours may vary without notice.
(d) Each Member is permitted to bring their children up to the age of 18 and 3 Invited Guests into the Virgin Australia Beyond Lounge.
(e) Where a Virgin Australia Beyond Lounge is not available, Members are welcome to enter the Virgin Australia Lounge in accordance with the Velocity Platinum lounge benefits.
(f) Where applicable, Members will have Velocity Platinum benefits to our Associated Lounges. Please check the Virgin Australia website here for more information.
(g) Access to Associated Lounges is subject to the terms and conditions of the applicable lounge. Please refer to the website of the Associated Lounge for further details.
6.2 Virgin Australia Beyond Lounge Facilities and Services
(a) It is important to understand that the services, facilities and benefits of the Virgin Australia Beyond Lounge may change over time.
(b) Subject to clause 6.2(c), Virgin Australia, acting reasonably, reserves the right to withdraw, cancel, vary or change the services and facilities offered to any Occupant by virtue of their Membership or of their access or entry to the Virgin Australia Beyond Lounge under these Terms and Conditions.
(c) Virgin Australia will use reasonable endeavours to advise Members of any material changes to the services or facilities offered in connection with the Virgin Australia Beyond Lounge benefit, using the email address recorded in the Member’s Velocity Account.
(d) Members may use boardrooms located in Virgin Australia Beyond Lounges, subject to availability and payment of the applicable boardroom booking fee. boardroom bookings and use will be valid as follows:
(i) Members must be travelling on a Virgin Australia domestic or international short haul flight departing on the same day to be eligible to use a boardroom in a Virgin Australia Beyond Lounge.
(ii) Reservations can be made by contacting the Virgin Australia Beyond team, or with Virgin Australia Beyond Lounge staff at reception. The applicable fee will be quoted at the time of booking.
(iii) Meeting room guests who are not Members are not permitted to access the Virgin Australia Beyond Lounge without the Member present. Use of Virgin Australia Beyond Lounge facilities by these guests is only permitted during the period of the boardroom booking.
(e) Access to computer facilities and the internet may be available in the Virgin Australia Beyond Lounge and is subject to availability. Virgin Australia does not represent or warrant that the computer facilities or internet access available within Virgin Australia Beyond Lounges are free from computer viruses or other defects. To the extent permitted by law, Virgin Australia is not liable for:
(i) Any third-party content on the internet that Members may find offensive, upsetting, or defamatory. Members are responsible for maintaining the security of all log-in identification information made available to you to access the internet or computer facilities in the Virgin Australia Beyond Lounge
(ii) Any security breaches suffered by Members when using the internet, including personal or information security breaches, and is not liable for any Loss suffered as a result of the unavailability of the internet or computer facilities, including interruptions during use.
(f) Members and any Invited Guests accessing the Virgin Australia Beyond Lounge are not permitted to make any audio recording or copy of the music playlists broadcast within the Virgin Australia Beyond Lounge. Any such content must be deleted upon reasonable request by Virgin Australia Beyond Lounge staff.
7. ACCESS TO THE VIRGIN AUSTRALIA BEYOND LOUNGE
7.1 General
(a) Virgin Australia Beyond Lounge operating hours may vary without notice.
(b) Access to the Virgin Australia Beyond Lounge and its services and facilities is subject to availability, and may be unavailable, restricted, limited or withdrawn at any time for capacity or operational reasons.
(c) Subject to applicable Laws, Virgin Australia Beyond Lounge staff may, refuse entry to any individual or require an Occupant to immediately leave the Virgin Australia Beyond Lounge, at any time if, in their reasonable opinion, the Member has not or will not comply with these Terms and Conditions or the Virgin Australia Lounge Terms and Conditions.
(d) All Virgin Australia Beyond Lounge Guests must:
(i) Use the Virgin Australia Beyond Lounge and its services and facilities appropriately and safely at all times
(ii) Drink responsibly within the Virgin Australia Beyond Lounge
(iii) Unless permitted for takeaway, consume all food and beverages made available within the Virgin Australia Beyond Lounge
(iv) Take responsibility for their belongings when inside the Virgin Australia Beyond Lounge
(v) Comply with smart casual dress standards at all times.
(e) All guests aged under 18 years:
(i) Must be accompanied by an adult when visiting the Virgin Australia Beyond Lounge
(ii) Are not permitted to access alcohol from the self-service bar.
(f) Lounge Guests are responsible for ensuring they arrive at the boarding gate for their departing flight at least 15 minutes prior to the scheduled departure time.
(g) Invited Guests must be accompanied by Members at all times and depart with Members.
7.2 Access on departure
(a) Members and their Invited Guests may access the Virgin Australia Beyond Lounge in the relevant departure port when the Member is travelling on a Virgin Australia flight departing on the same day.
7.3 Access on arrival
(a) Subject to space availability, Members with a same day Virgin Australia flight, and their Invited Guests, may access the Virgin Australia Beyond Lounge upon arrival into their destination port.
(b) Members must enter the Virgin Australia Beyond Lounge in their destination port within 60 minutes of arrival of their same day Virgin Australia flight.
7.4 Identification requirements
(a) To access the Virgin Australia Beyond Lounge, Members must provide their:
(i) Membership Card
(ii) Boarding pass for their Virgin Australia flight departing on the same day
(iii) Satisfactory proof of identity (e.g., a driver's licence), if required.
7.5 Invited Guest access
(a) Invited Guest access to the Virgin Australia Beyond Lounge is subject to space availability at all times and may not be available during peak periods.
(b) Invited Guests must be accompanied at all times by a Member who is travelling on a Virgin Australia flight departing on the same day. Invited Guests are not required to be travelling.
(c) As outlined in clause 6.1(d), Members can each bring up to 3 Invited Guests into the Virgin Australia Beyond Lounge.
(d) Any additional guests above the limit will be denied entry unless pre-approved by Virgin Australia or Virgin Australia Lounge Leaders on an exceptions basis.
(e) Children (under the age of 18) of Members, are not considered to be Invited Guests, and may enter the Virgin Australia Beyond Lounge when accompanied by the Member.
8. LIMITATION OF LIABILITY
(a) These Terms and Conditions (as amended from time to time), together with the Lounge Terms and Conditions and the Velocity Frequent Flyer Terms and Conditions, set out the entire agreement with the Member regarding Membership and any conditions of entry to and use of the Virgin Australia Beyond Lounge. However, nothing limits our liability for representations or other communications (either written or oral) made by Virgin Australia where such liability cannot be excluded by law.
(b) Except where we have specified in these Terms and Conditions, or where the law does not permit us to limit or exclude our liability, whether under the Australian Consumer Law or otherwise, we exclude our liability for:
(i) Any Loss incurred as a result of, or in connection with, a Membership, access to the Virgin Australia Beyond Lounge, or these Terms and Conditions, whether the same arose from negligence, breach of contract or otherwise, and regardless of whether we have any control over circumstances giving rise to the claim or not; and
(ii) Any Loss suffered in relation to the supply of goods or services by third parties.
(c) To the extent permitted by law, Virgin Australia will not be liable for any Loss whatsoever which you or anyone else may suffer as a result of any termination or suspension of your Membership.
9. PRIVACY & MARKETING
9.1 Personal information
(a) You agree that your personal information will be managed in accordance with our Privacy Policy, available here. We may collect personal information about a Member’s executive assistant, Invited Guests and any other third parties who interact with us on your behalf, use your Membership benefits or whose personal information you otherwise provide to us. Where you have authorised someone to act on your behalf, we may collect your personal information from and share it with that person.
(b) We are required to collect personal information in order to provide the Membership and communicate about the Membership. If we cannot collect the minimum amount of personal information required, we will not be able to provide Membership or provide Members or others nominated by the Member with Membership benefits.
(c) Before providing personal information to us about any other person, it is the Member’s responsibility to make that person aware:
(i) Of the disclosure of their personal information to Virgin Australia and Velocity Frequent Flyer for the purposes outlined above in clause 9.1(a)
(ii) That their personal information will be handled in accordance with the Virgin Australia Group Privacy Policy.
(d) Members must also obtain the person’s consent for us to collect and handle any sensitive information about them if provided to us, such as dietary requirements or special assistance requirements, to allow us to provide or arrange the Membership benefits and any other products and services requested.
9.2 Marketing
(a) Unless Members have opted out, Members have provided consent to receive direct marketing and promotional materials as set out in clause 1.2 of the Velocity Frequent Flyer Terms and Conditions and the Virgin Australia Group Privacy Policy.
(b) Members can opt out of direct marketing at any time by:
(i) Using the “unsubscribe” facility in electronic messages
(ii) Managing their contact preferences through their Velocity account when logged in
(iii) Or, by contacting the Virgin Australia Beyond team.
(c) After opting out, Members will continue to receive important service-based messages from Virgin Australia and Velocity Frequent Flyer about their Membership.
(d) If Members only opt out from some channels, direct marketing may still be sent or displayed via alternative channels (e.g., opting out of email marketing will not block SMS text message marketing or targeted online advertising).
(e) Members can read more about our marketing practices in the Virgin Australia Group Privacy Policy, including how to manage their marketing communications preferences.
10. GENERAL
(a) These Terms and Conditions are governed by, and will be construed in accordance with, the law in force in the State of Queensland, Australia. Members agree to submit to the non-exclusive jurisdiction of courts of that State.
(b) If any provision in these Terms and Conditions is void or unenforceable, that provision will be read down to the extent necessary to make it valid and enforceable and, to the extent that it cannot be so read down, it will be deemed to be severed from these Terms and Conditions.
